1. General

1.1 These terms of service govern the use of the software “Nomindo” (hereinafter referred to as “Software”), which is operated by the association “Travelburras” (hereinafter referred to as “Association”).

1.2 The Software is a platform for planning, discovering, documenting, and sharing trips with a camper.

2. Right of Use

2.1 The Software is licensed under the AGPLv3 license. The name “Nomindo” is a registered trademark.

2.2 The use of the Software is currently free of charge. The Association reserves the right to introduce paid features in the future.

2.3 Membership in the Association is not required for use. Voluntary membership contributions are possible.

2.4 The use of the Software is open to people worldwide.

3. Technical Requirements

3.1 A web browser and internet access are required to use the Software.

3.2 Updates to the Software are automatically provided as soon as new versions are available.

4. Data Storage and Security

4.1 The data is stored on servers of Hetzner in Germany.

4.2 Daily backups of the data are created.

4.3 User data is stored until it is deleted by the user.

4.4 No guarantee is given for the availability of the Software.

5. User-Generated Content

5.1 Users can share their travel reports, travel plans, and routes with others.

5.2 The rights to user-generated content remain with the respective user.

5.3 The Association may use user-generated content for marketing purposes.

5.4 Commercial use of user-generated data (e.g., through advertising or sale) is prohibited.

6. Costs and Fees

6.1 The currently available features remain free of charge.

6.2 Usage fees may be charged for certain services in the future (e.g., additional storage space for photos).

6.3 Payment modalities can be one-time or monthly, depending on the chosen model.

6.4 Paid services can be canceled monthly or according to the respective model conditions.

7. Liability and Warranty

7.1 No warranty is given for the Software.

7.2 The liability of the Association is limited to intent and gross negligence.

7.3 The Association is not liable for damages caused by force majeure.

8. Data Protection

8.1 Information on the processing of personal data can be found in the separate Privacy Policy.

9. Changes to the Terms of Service

9.1 The Association reserves the right to change these terms of service.

9.2 Users will be informed of significant changes to the terms of service.

10. Final Provisions

10.1 Should individual provisions of these terms of service be invalid, the validity of the remaining provisions shall remain unaffected.

10.2 These terms of service are subject to Swiss law.

10.3 The place of jurisdiction is the seat of the Association.
